Divorce Asset Protection

Divorce asset protection is not one of the first things that comes to mind when your spouse serves you with papers.  At that point it’s probably too late.

Nonetheless, if you feel a divorce may be inevitable and you haven’t planned well, the division of property will turn into a major focal point of litigation.

So, one of the best things to take control of before papers are filed is hiring a professional appraiser and let them take control of your divorce asset protection strategy.

I say this because asset protection typically involves taking action to protect your financial future and avoid an inequitable property division arrangement.

A specialist can make a considerable difference because the division of property  is established by taking the fair market value of any disputed items to make sure one spouse isn’t granted more than the other one.

The trouble is, if you don’t quickly as the relationships comes apart and let your spouse act first you are reacting to her, which is a bad place to be in a divorce.  You must act first so you’re in front of the game, because your spouse will plan her attack on your assets before filing.

After this discreet evaluation there are things you can do to ensure your affairs restricted and away from anyone’s prying eyes.  Keep in mind that when it comes to assets, information is critical. Stop her or her lawyer from uncovering that knowledge and they’ll always be chasing after you for that information.

If you screw up and your ex-wife or her lawyer get that knowledge regarding your affairs you’ll be playing catch up with your wife as she tries to leverage her knowledge of precisely what you own.

Strategically, privacy is evidently enormously important to you and ought to be the basis of your asset protection.

This is correct because in today’s world men need to learn that women, with their security focus, take planning seriously.

Men often believe getting a good lawyer is all that’s required of them.  You need to be pro-active when protecting your assets,  not putting blind trust in a lawyer that everything will just work out.

So what must you do?  Plan, expect, and prepare for the worst.  Divorce is more contentious today and you want to go into this battle with a motivation on winning, because nice guys get smoked.

Divorce asset protection does not just happen, you must plan it and plan it well.

I have been divorced for 18 months and my ex wife is now telling me she has been to a lawyer and she wants 60% of the house and half of my superannuation. The divorce certificate states ‘ if a party proposes to make such application must be made within 12 months or the divorce order taking effect. after that time such an application cannot be made without first obtaining the leave of the Court’ What does that mean. Can she do this. She is living in the house and I was prepared to give her the house. HELP… The divorce order takes effect from the second day of August 2008.
